The current debates on the Violence Assistance Act and criminal law reforms show serious gaps:
🔴 Lack of implementation: Despite political announcements, there has been little progress, particularly with regard to the funding of women's shelters. The FDP has blocked previous measures and it is unlikely that they will be passed in this legislative period.
⚖️ Criminal law reforms: Lawyers such as Christina Clemm and Julia Habermann are calling for stricter sanctions for perpetrators, including in cases of gang rape. The proposal to introduce "physical superiority" as an aggravating factor remains controversial.
⚠️ Deleted protective measures:
- No protection for trans, inter and non-binary people - removed from the draft bill under pressure from the CDU/CSU.
- No unrestricted right to protection for all victims of gender-based violence.
- Women refugees still at a disadvantage - Barriers to accessing shelters remain in place.
Conclusion: People affected by violence continue to be inadequately protected. Instead of real reforms, there are setbacks - despite the urgency of comprehensive prevention and support systems.
